General Terms & Conditions

1. Purpose and scope

These General Terms and Conditions of Sale (T&Cs) apply to all services offered by Demessine Emilie – ED Punez Picco, as a sole trader, namely:
– services for private clients (portraits, personalised items, hand‑crafted creations)
– services for professional clients (diagnostics, tailored support, visual creations, project dossiers, etc.).
Any order implies full and unconditional acceptance of these T&Cs.

3. Specific terms – Portraits & Objects (private clients)
3.1. Description

The products are bespoke artworks and hand‑crafted items (Portrait Packs, personalised objects). Descriptions and visuals on the site are provided for guidance only. Minor variations may occur due to the handmade, unique, artisanal nature of the products.

3.2. Prices

Prices are indicated in euros (€) and US dollars (USD), all taxes included (TTC), covering artistic creation, the physical support, and delivery where specified (notably for Europe and North America, see 3.6). VAT not applicable, art. 293 B CGI.

3.3. Formation of the contract

The Client selects a pack or product. Once the brief form or email has been received, the Artist confirms whether or not the order is feasible. If the order is accepted, it is finalised when payment is confirmed. Any order thus validated constitutes acceptance of these T&Cs and of the stated price.

3.4. Payment

The order is confirmed after validation by the Artist and full payment, or according to the terms stated in the quote / confirmation email. Payments may be made by bank card via Stripe or PayPal.

3.5. Lead times

Estimated delivery times are indicated on each product page (generally around 3 weeks). They are provided for information only and may vary depending on the product ordered and the carriers used.

3.6. Delivery areas and fees

Delivery is available worldwide. Delivery costs are included for Europe and North America for Portrait Packs. For other regions or items, shipping fees are calculated at the time of order.

3.7. Right of withdrawal (legal exclusion)

In accordance with Article L221‑28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalised.

As a result, any order for a portrait or personalised object is firm and final and cannot be refunded or exchanged, except in the event of a manufacturing defect or proven error on my part (see Warranty).

3.8. Warranty

All products sold benefit from the statutory warranties of conformity and hidden defects. In case of a proven defect on receipt, the Client must contact the Seller within 7 days so that the situation can be resolved.

3.9. Intellectual property and use

The Artist (Demessine Emilie) retains full copyright. The Client acquires the right to use the work for strictly personal purposes (home display, gift). Any commercial use, reproduction for resale, or modification is strictly prohibited without prior written licensing agreement.

4. Specific terms – Professional services (creation & diagnostics)
4.1. Nature of services

Professional services include, in particular: structuring diagnostic, bespoke support, project dossiers, visual creations and other services described on the site or in quotes.

4.2. Diagnostic fees

Some diagnostics have a fixed fee displayed on the site (for example, the Structuring Diagnostic). The applicable price is that shown at the time of the request, unless otherwise stated clearly before confirmation.

For the “Projects” offer, a base fee may be indicated as a guide. This may be adjusted depending on project complexity, document volume and deadlines, after written exchange with the Client. The final amount is confirmed before any payment is requested.

4.3. Tailor‑made support and projects

Support, revamps, visual creations and art projects are subject to a specific quote, established based on the diagnostic or initial project analysis. The fee already paid for a diagnostic may, where applicable, be offset partially or fully against the overall price, as set out in the proposal.

4.4. Ordering process for professional services

The Client contacts the Artist‑consultant by email or via the dedicated form to present their situation or project.

  • For fixed‑price diagnostics, the Artist‑consultant confirms acceptance and sends a payment link and, where applicable, access to the form to be filled in.
  • For tailor‑made support or projects (visual identity, project dossiers, website revamp, etc.), the Artist sends a quote detailing scope, deliverables, timelines and price.

The order is considered firm as from written acceptance of the quote and/or payment of the deposit or total amount indicated. Any order thus validated constitutes acceptance of these T&Cs.

4.5. Right of withdrawal – Professional clients

The services offered to professional clients (diagnostics, support, visual creations, project dossiers, etc.) are performed in the course of their main activity. Consequently, the right of withdrawal provided for consumers under the French Consumer Code does not apply.

Once the quote has been accepted and/or payment made, the order is firm and final, except where otherwise agreed in writing or in cases of force majeure. Amounts paid remain due to the Provider for work already carried out or booked.

In case of difficulty or major unforeseen circumstances, the Client is invited to contact the Provider as soon as possible to jointly review possible adjustments to the schedule or scope.

4.6. Intellectual property and use

Unless otherwise specified in the quote or contract, the Artist / Provider (Demessine Emilie – ED Punez Picco) remains the sole holder of all intellectual‑property rights over the creations produced (texts, dossier structures, recommendations, visual identities, illustrations, mock‑ups, etc.).

The professional Client is granted a right of use limited to the needs defined in the service (communication of their activity, responses to calls for projects, presentation dossiers, internal or external materials), for the territories, durations and media specified in the quote. Any use outside this framework (new media, new campaign, transfer to third parties, substantial modification, etc.) must be subject to prior written agreement and, where applicable, an additional fee.

Where the quote provides for a partial or full transfer of rights, this is expressly defined (nature of rights transferred, duration, territory, media). In the absence of such detail, no transfer of rights is deemed to be included beyond the strict use necessary for the service as described in the quote.

5. Disputes and consumer mediation

In the event of a dispute between the Client and the business, both parties will first seek an amicable resolution (the Client will send a written complaint to the professional or, where applicable, the professional’s customer‑relations service).

Failing an amicable agreement or any response from the professional within a reasonable period of one (1) month, the Client who qualifies as a consumer under Article L.612‑2 of the French Consumer Code has the option of referring the matter, free of charge, to the competent consumer mediator listed by the Commission for the Evaluation and Monitoring of Consumer Mediation, in accordance with Article L.615‑1 of the French Consumer Code.

Consumer mediator (legal obligation)

In accordance with Article L.612‑1 of the French Consumer Code, the Client has the right to use a consumer mediator free of charge in order to seek an amicable resolution of the dispute.

Applicable law and jurisdiction

These T&Cs are governed by French law. Failing an amicable resolution, the competent court shall be that of the Seller’s domicile.
